Privacy Policy

The state-funded Utah Preparing Students Today for a Rewarding Tomorrow (UPSTART) program is powered by Waterford Research Institute™. We recognize that participants in this program may be concerned about the information they provide to us, and how we treat that information. This Privacy Policy addresses those concerns. This policy may be changed or updated from time to time. When you agree to this Privacy Policy, you are agreeing to any and all updates.

Privacy Questions

  1. What information does Waterford Research Institute™ (“Waterford”) collect from me and how does the Institute use it?

    Participant Application

    In order for a child to participate in UPSTART, we permit only a parent or a legal guardian of that child to apply. During the telephone registration process, we will collect your family’s complete contact information, your child’s information, and your family’s demographic information. The following section details how that information will be used.

    Waterford recognizes the importance of protecting your information. In order to support your participation in UPSTART, we may need to share your contact information from the participant application form with UPSTART technical support organizations. We will not, however, under any circumstances, sell or rent your information to any party.

    • Contact Preferences: Our friendly User Support is designed to keep in close contact with you during your participation in UPSTART. You can specify the method, days of the week, and hours when you would prefer that we contact you. We may be letting you know about training opportunities, following up with your questions or issues, and/or reminding you to keep using the program.
    • Secondary contact: We will ask for a name and phone number of someone we can contact if we are unable to contact you. This information is optional. We will only contact this person if we are unable to contact you after attempting to do so for one month or more.
    • Mailing address: Your start–up kit will be shipped to this address. In addition, if you do not have an e–mail address, we will send all Waterford communication to this address. Your child may also receive certificates and other motivational materials mailed to this address. The UPSTART program contains NO advertising or product placement.
    • Phone numbers: If phone is not your preferred method of contact, we will only call you if other methods of contact do not work.
    • E-mail address: For participants with an e–mail address, this address will be your username in the program. Waterford has a zero spam policy. We will only send you e–mails that are related to your personal participation in UPSTART.
    • Computer information: For applicants with a computer, we will ask about your operating system, CPU, RAM, and Internet connection. We will use this information to determine whether the program will work on your computer system and to better support you as a participant.
    • Computer-on-loan application: For applicants who want to receive a computer on loan, we will ask for household income level, family size, and participation in Food Stamps, WIC, and Free and Reduced School Lunch. This information is necessary to meet the State funding requirements for this program. Applicants will also be asked whether they have space and an electrical outlet for this equipment.
    • Child’s first name: Waterford recognizes the importance of protecting your child’s privacy. We are collecting his or her name for the following reasons and we will give you the opportunity to delete it at the end of your participation in UPSTART. Each start–up kit will arrive already set up for your child. Your child will click his or her name to begin the program each day. Each child begins the program by learning how to spell his or her name (as provided here). Certificates and awards in the software will use your child’s name.
    • Child’s demographic information (gender, ethnicity, primary language, and secondary language): Waterford will collect your child’s demographic information in order to report program results to the Utah State Office of Education in aggregate (averaged, anonymous).
    • Child’s birth date: This information will be used ONLY to determine your child’s eligibility for the program. Children must be born between March 2, 2004 and March 1, 2005 to be eligible for participation in UPSTART.
    • Child’s Year Entering Kindergarten: UPSTART participation ends when the child enters kindergarten. Waterford will use this information to set an end date for your participation in the program.
    • Child’s future school and future school district: This optional information will be used only to report program results in aggregate (averaged, anonymous) to the Utah State Office of Education.
    • Child’s other preschool participation: This information has NO impact on your child’s eligibility to participate in UPSTART. Waterford will use this information in aggregate (averaged, anonymous) to report program results.
    • Caregiver’s education level, work hours, and marital status: This information has NO impact on your child’s eligibility to participate in UPSTART. Waterford will use this information in aggregate (averaged, anonymous) to report program results.
    • Household income level, family size, and state program participation: This information has NO impact on your child’s eligibility to participate in UPSTART. Waterford will use this information in aggregate (averaged, anonymous) to report program results.
    • Tell a Friend: You can easily refer friends to UPSTART with our “Tell a Friend” feature. If you choose to use this feature, Waterford will send one personalized email to your friend about UPSTART. We will not, under any circumstances, sell or rent your friend’s email address and we will not send any further emails to his or her address without his or her explicit request to do so.
  2. What information does Waterford Research Institute™ (“Waterford”) collect directly from my child?

    Reading Assessment (Waterford Assessments of Core Skills™)

    Participants will use a friendly computer-based reading assessment at the beginning, middle, and end of their participation in UPSTART. The following section outlines how information collected from the test will be used.

    • Date and time of test administration: This information will simply be used to confirm that each child has participated in the test at the designated time.
    • Scores on all subtests: Waterford will use this information in aggregate (averaged, anonymous) to report program results.
    • Profile of your child’s responses: We only access this usage data in an aggregate (averaged, anonymous) way and keep such data in a separate database from your account information. Waterford uses this data to evaluate the effectiveness of our programs. Waterford’s policy is to retain profile data for as long as feasible (generally 6 months or longer). If you wish Waterford to make your child’s data completely anonymous by removing your child’s name at the end of your participation in UPSTART, please contact support@Waterford.org.

    Preschool Instruction (Rusty and Rosy Learn with Me™ and Camp Consonant™)

    Participants will use the Preschool Instruction for at least 15 minutes a day, 5 days per week. The program automatically picks up each day where the child left off the day before. The following section outlines how information collected from the programs will be used.

    • Date and exact time of use: This information will be used to confirm that your child is benefiting from participation in UPSTART.
    • Your child’s learning profile: This information must be collected in order to pick up each day exactly where your child left off. We only access this usage data in an aggregate (averaged, anonymous) way and keep such data in a separate database from your account information. Waterford uses this data to evaluate the effectiveness of our programs and to evaluate your possible access to a supplemental learning program available in UPSTART. Waterford’s policy is to retain profile data for as long as feasible (generally 6 months or longer). If you wish Waterford to make your child’s data completely anonymous by removing your child’s name at the end of your participation in UPSTART, please contact support@Waterford.org.
  3. Who has access to my information?

    The UPSTART Team

    The UPSTART team will be providing support and services to you during your participation. This team will include Waterford employees as well as employees from other technical support organizations. They will have access to your contact information.

    Waterford User Support

    Waterford User Support will have access to everything provided in the participant application as well as your program usage. They will be using this information to let you know about training opportunities, follow up with your questions or issues, and/or remind you to keep using the program.

    Waterford Research Team

    The Waterford Research Team consists entirely of Waterford employees. This team is responsible for reporting the results of UPSTART to the Utah State Office of Education and others. As such, they will have access to your child’s learning profile, program usage patterns, test results, and demographic information. They will be accessing the data in order to generate aggregate (averaged, anonymous) reports on the program’s success.

    External Evaluator

    As part of UPSTART legislation, an external evaluator was selected to conduct a formal review of the effectiveness of this program. The external evaluator will have access to your child’s learning profile, program usage patterns, test results, and demographic information. They will be accessing the data in order to generate aggregate (averaged, anonymous) reports on the program’s success.

  4. Can I opt–out of providing any of the information requested?

    Waterford is collecting the information required to report UPSTART program results in an aggregate, anonymous way to the Utah State Office of Education and others. In addition, you child’s learning profile information is required to ensure the preschool program operates consistently and accurately. Therefore, all the information we request is mandatory, with the exception of certain marketing and support information, such as where you heard about UPSTART and a secondary contact.

  5. Can I review and modify information you collect from me?

    Please call User Support to review and/or update your information (1–800–669–4533).

  6. How does Waterford protect my information from loss, misuse or alteration?

    Waterford has security measures in place to protect the loss, misuse or alteration of information under our control. Waterford uses Secure Sockets Layer (SSL) to encrypt information that you transmit to us over the Internet. Once we receive your transmission, we will store all information on secure servers behind a firewall. In addition, only the Waterford management team and the Waterford Research and Evaluation Department can access the information stored on these servers and in these databases. The Waterford management team and engineers will continuously review and update the integrity of the program and the security of your personal information. Waterford cannot, however, safeguard any data stored on your own personal computer or any public computer upon which you might elect to access UPSTART.

  7. Will Waterford sell my information to third parties?

    Waterford recognizes the importance of protecting your personal information. Waterford will not, under any circumstances, sell or rent your information to any party.

  8. Will Waterford send me unsolicited third-party promotional emails?

    No. Waterford will only contact you regarding your participation in UPSTART.

  9. Will the UPSTART software use Cookies?

    A cookie is information that Waterford software may put on your computer’s hard drive so that Waterford can (1) identify the Waterford user and session through a randomly assigned Waterford ID number AND/OR (2) automatically sign you in so that you do not have to enter a username and password each time you visit if you select “remember me”. No personal information is ever stored in a Waterford cookie.

Other Privacy Information

  1. Children’s Online Privacy Protection Act

    The Children’s Online Privacy Protection Act of 1998 (COPPA) was enacted by Congress to protect children’s privacy during use of the Internet. Waterford programs comply with this Act.

  2. The Children’s Internet Protection Act

    Enacted by Congress in December 2000, the Children’s Internet Protection Act (CIPA) addresses concerns about access to offensive content over the Internet on school and library computers. Waterford programs are appropriate for preschoolers. In most cases, the children will not be working in a standard Internet browser so it is VERY unlikely that a preschooler would be able to access the Internet during use.

  3. The Family Educational Rights and Privacy Act

    The Family Educational Rights and Privacy Act (FERPA) is a Federal law that protects the privacy of student education records. The law applies to all schools and other educational institutions that receive funds under an applicable program of the U.S. Department of Education.
